HASL RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, IDEMNITY AND AGREEMENT NOT TO SUE. YOU WILL GET INJURED PLAYING SOCCER IN THE HASL. DO NOT PLAY IF YOU FEEL YOU WILL NOT GET INJURED. HASL DOES NOT CARRY INSURANCE
In CONSIDERATION OF BEING ALLOWED TO PLAY IN THE HOBOKEN ADULT SOCCER LEAGUE (HASL) AND USE THE CITY OF HOBOKEN PARKS, FIELDS AND FACILITY. I AGREE THAT THERE IS A HIGH PROBABILITY THAT I WILL BE INJURED AND FURTHERMORE I AGREE THAT I WILL NOT SUE THE HOBOKEN ADULT SOCCER LEAGUE, COUNTY THEIR OWNERS AND OPERATORS, CONTRACTORS AND THEIR OFFICERS, DIRECTORS, AGENTS, ITS PLAYERS, REFEREES, SERVANTS AND EMPLOYEES, THE CITY OF HOBOKEN AND HUDSON COUNTY. AND WILL RELEASE HASL FROM ANY AND ALL LIABILITY IF I AM OR EVER WAS INJURED WHILE USING ANY OF THE FACILITIES OR WHILE PRESENT ON THE CITY OF HOBOKEN OR HUDSON COUNTY PROPERTY, EVEN IF I CONTEND THAT SUCH INJURIES ARE THE RESULT OF NEGLIGENCE, INCLUDING GROSS NEGLIGENCE, OR ANY OTHER IMPROPER CONDUCT FOR WHICH A RELEASE IS NOT CONTRARY TO PUBLIC POLICY, ON THE PART OF THE HASL OR THE CITY OF HOBOKEN AND HUDSON COUNTY.
IN CONSIDERATION of being permitted to compete, officiate, observe, play for, or participate in any way in The Hoboken Adult Soccer League (HASL) EVENT(S) or being permitted to enter for any purpose any RESTRICTED AREA (defined as any area requiring special authorization, credentials, or permission to enter or any area to which admission by the general public is restricted or prohibited), EACH OF THE UNDERSIGNED, for himself, his personal representatives, heirs, and next of kin:
1. Acknowledges, agrees, and represents that he/she has or will immediately upon entering any of such Field Areas, and will continuously thereafter, inspect the Field Areas which he/she enters, and he/she further agrees and warrants that, if at any time, he/ she is in or about Field Areas and He/ She feels anything to be unsafe, he/she will immediately advise the officials/ Referees of such and if necessary will leave the Field areas and/or refuse to participate further in the HASL EVENT(S).
2. HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE the promoters, participants, HASL associations, sanctioning organizations or any subdivision thereof, Referees, Field owners, officials, players, crews, personnel, any persons in any Field AREA, promoters, sponsors, advertisers, owners and lessees of premises used to conduct the EVENT(S), premises and event inspectors, surveyors, underwriters, consultants and others who give recommendations, directions, or instructions or engage in risk evaluation or loss control activities regarding the premises or HASL EVENT(S) and each of them, their directors, officers, agents and employees, including Hoboken Adult Soccer League, City of Hoboken and their offices, Hudson County and their officers, employees and agents on their behalf all for the purpose herein referred to as “Releases,” FROM ALL LIABILITY TO THE UNDERSIGNED, his personal representatives, assigns, heirs, and next of kin FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFOR ON ACCOUNT OF INJURY TO THE PERSON OR PROPERTY OR RESULTING IN DEATH OF THE UNDERSIGNED ARISING OUT OF OR RELATED TO THE EVENT(S), WHETHER CAUSED BY THE NEGLIENCE OF THE RELEASEES OR OTHERWISE.
3. HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Releases and each of them FROM ANY LOSS, LIABILITY, DAMAGE, OR COST they may incur arising out of or related to the EVENT(S) WHETHER CAUSED BY THE NEGLIENCE OF THE RELEASEES OR OTHERWISE.
4. HEREBY ASSUMES FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE arising out of or related to the EVENT(S) whether caused by the NEGLIGENCE OF RELEASEES or otherwise.
5. HEREBY acknowledges that THE ACTIVITIES OF THE EVENT(S) ARE VERY DANGEROUS and involve the risk of serious injury and/or death and/or property damage. Each of THE UNDERSIGNED, also expressly acknowledges that INJURIES RECEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES OF THE RELEASEES.
6. HEREBY agrees that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by the Releases, INCLUDING NEGLIGENT RESCUE OPERATIONS and is intended to be as broad and inclusive as is permitted by the laws of the Province or State in which the Event(s) is/are conducted and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. I have read and understood the foregoing AGREEMENT NOT TO SUE AND ACKNOWLEDGMENT OF RISKS and that the HASL does not carry Insurance and am voluntarily signing below, intending to be legally bound hereby. I MUST BE 18 to Play and I have made no misrepresentations of my age.
